Warranty
Danish Myo Technology A/S warrants to the original user that myograph systems manufactured by Danish Myo Technology A/S will be free from defects in materials and workmanship for a period of two (2) years after the date of delivery. Danish Myo Technology A/S will repair or replace any defective part, subject to the conditions, limitations and exclusions.
Exclusions
Force and pressure transducers, separately or part of myograph systems manufactured by Danish Myo Technology A/S, are disclaimed from any warranty.
Limitations
This warranty shall not apply to equipment subjected to accidental damage, improper use, alteration, or deterioration.
Warranty on third-party products will be as determined by their respective manufacturer.
Danish Myo Technology A/S shall not be liable for consequential, incidental, special, or other direct or indirect damages resulting from economic loss or property damage sustained by you or any end user from the use of the products sold or services rendered hereunder.

A "Return Material Authorization" (RMA) number is required for all returns. This number should be clearly indicated on all returned myograph systems.
Products damaged due to improper or inadequate packaging when returned for RMA purposes are not granted warranty coverage.

Prices
The prices listed or quoted are in the currency of Euros (EUR) or American Dollars (USD) unless other specified.
Price Fluctuation
We reserve the right to revise any price in case of currency fluctuations, raw material costs or increased costs outside our control. In the event of change 90 days of notification is given.
Should customers, who have purchased systems under the DP, wish to use the systems commercially, by themselves or through a 3rd party organization, an industrial license must be purchased. If the systems are originally purchased without the DP, there are no limitations attached to the purchase.
VAT Taxes & Customs Duties
Prices listed in the catalogue do not include VAT, taxes or custom duties. Orders for DK delivery will be subject to VAT at the prevailing rate.
Customers will be responsible for the payment of the charges that apply to their order.
European Community Countries VAT
All invoices to EC members have to show the VAT No. of both the customer and supplier. If the EC customer fails to provide a valid VAT number, we must add Danish VAT rate (25%) to the invoice.
Terms of Payment
For account customers, terms of payment are Net 30 days from invoice date. Invoice date is date of shipping.
Late Payment
We reserve the right to delay delivery if there are overdue invoices on the account. Accounts, which remain unpaid beyond the due date, will incur an interest charge of +1.5% per beginning month.
Title
Title to the goods shall remain the property of DMT until payment has been received in full. The retention of title shall not affect the passing of risk.
Risk
The risk will pass to Purchaser no later than when DMT hands the product over to the first carrier.
Dispatch
A forecast is given in all written quotations, and every effort will be made to dispatch within this timescale. However, we shall under no circumstance be liable for loss, whether direct or consequential, arising from delay in dispatch.
For export orders dispatch will be conditional on our obtaining export licenses or any other necessary governmental requirements.
Shipment
Freight charges are unknown at the time of order creation, unless specified or
included in the written quotation. If so, we will determine the most expeditious and efficient means of shipment.
Appurtenant charges (such as freight and insurance), will be added to your invoice. These charges are determined at the time of shipment by total weight and dimensions of shipment.
Split Shipments
Whilst every attempt will be made to avoid split shipments, we reserve the right to split ship at our discretion.
Claims
Any claims in respect of short delivery, incorrect material, or defective quality must be notified to us in writing within seven days of delivery.

Product Liability
We shall have no obligation if damage occurs due to improper handling or operation, abuse, misuse, unauthorised repairs made or attempted.
DMT's liability for any and all losses and damages to Purchaser, in any way arising out of or connected with this transaction, from any cause what so ever, shall be limited to the repair or replacement of defective material or workmanship in the purchased product.
We are under no circumstances liable for any operating loss, loss of time, loss of profit and similar indirect or consequential losses.
Specifications
Our policy is to continue to improve specifications and we reserve the right to alter published specifications without notice. We supply materials according to our specification. We make no warranty as to the fitness of the materials for any specific application.
Orders
All orders are subject to acceptance of our Standard Terms and Conditions of Sale (STCS).
Cancellation of orders
Orders may be canceled prior to delivery if written notification is forwarded to us. In the event of cancellation, 10% of the original purchase will be charged.
Product Design Changes
Due to continuing improvements in design, some items may differ slightly from the description and photograph in product specification sheet, brochures and user manuals. Specifications are subject to change without notice.
Law
Any dispute or claim arising out of or in connection with this Agreement or in connection with its performance, any breach, termination or invalidity thereof shall be settled by arbitration in accordance with the Rules of Procedure of the Danish Institute of Arbitration (Copenhagen Arbitration).
