DMT hardware warranty coverage and claims procedure

Review what the DMT warranty covers, the applicable warranty periods, the principal exclusions and the steps required when requesting assessment, repair or replacement.

Important points before submitting a claim

Original purchaser only The warranty is non-transferable and applies to the original purchaser.

Warranty coverage depends on the product, the date of shipment, the reported defect, the operating conditions and compliance with DMT’s published instructions.

Warranty claim process

Three steps before a product is returned

Submit the claim first, wait for DMT’s assessment and obtain an RMA number before arranging shipment.

Notify DMT in writing

Submit the issue within 30 days after it becomes apparent and no later than the end of the applicable warranty period.

  • Product name and model
  • Serial number
  • Shipment or purchase date
  • Description of the defect
  • Relevant photographs or documentation

Obtain an RMA number

No product may be returned without a valid Return Material Authorization number issued by DMT.

  • Wait for DMT’s return instructions
  • Mark the RMA number on the outer packaging
  • Do not ship unapproved products
  • Unidentified returns may be refused
03

Package and return correctly

Use adequate protective packaging and follow the shipping instructions supplied with the RMA.

  • Protect precision and mechanical components
  • Include the requested documentation
  • Customer normally pays shipment to DMT
  • DMT normally pays standard return shipment
  • Customs, VAT and import charges remain with the purchaser

DMT Warranty Terms & Conditions

These terms apply to eligible DMT-manufactured products supplied to the original purchaser.

Section 1

Warranty Coverage

Danish Myo Technology A/S (“DMT”) warrants to the original purchaser that myograph systems and other hardware products manufactured by DMT will be free from defects in materials and workmanship under normal use and in accordance with DMT’s published instructions for a period of two (2) years from the date of shipment from DMT’s facility, as evidenced by DMT’s shipping records (“Warranty Period”).

During the Warranty Period, DMT will, at its sole discretion:

  • Repair the defective product or component;
  • Replace the defective product or component with a new or refurbished equivalent; or
  • Refund the purchase price of the defective product or component.

The foregoing remedies constitute the purchaser’s exclusive remedies under this warranty.

This warranty is non-transferable and applies solely to the original purchaser.

Section 2

Transducer Warranty

Force and pressure transducers, whether supplied separately or as part of a myograph system, are warranted for a period of six (6) months from the date of shipment, covering defects in materials and workmanship under normal operating conditions.

This warranty does not cover damage resulting from overload, misuse, contamination, corrosion, accidental damage, improper handling, unauthorized modification, or operation outside specified limits.

Transducers are precision measurement components subject to wear during normal laboratory use. DMT recommends periodic inspection and recalibration in accordance with the applicable product documentation.

Section 3

Software

DMT software products, including but not limited to MyoDAQ, MyoVIEW, MyoNORM, and MyoPULSE, are provided under a separate Software License Agreement and are not covered by this hardware warranty.

DMT warrants that software will perform substantially in accordance with its documentation at the time of delivery. Software defects should be reported to DMT Technical Support.

Software updates, upgrades, enhancements, and bug fixes may be provided at DMT’s discretion and are not guaranteed under this warranty.

Section 4

Warranty Exclusions

This warranty does not apply to damage, defects, or failures resulting from:

  • Accidental damage, misuse, abuse, negligence, or improper maintenance;
  • Unauthorized modification, alteration, repair, or service;
  • Use inconsistent with DMT’s published instructions, protocols, specifications, or intended use;
  • Normal wear and tear, including wear to consumable components;
  • Calibration drift resulting from normal use;
  • Damage caused by improper packaging during customer-initiated returns;
  • Environmental conditions, power fluctuations, flooding, fire, lightning, transportation damage, or other external causes;
  • Products with altered, removed, or illegible serial numbers;
  • Third-party products or components not manufactured by DMT, which remain subject solely to the warranty provided by their respective manufacturer.
Section 5

Limitation of Liability

To the maximum extent permitted by applicable law, DMT’s liability under this warranty is limited exclusively to the remedies described in Section 1.

DMT’s total aggregate liability arising out of or relating to any warranty claim shall not exceed the purchase price paid for the affected product.

DMT shall not be liable for any consequential, incidental, indirect, special, exemplary, or punitive damages, including but not limited to:

  • Loss of data;
  • Loss of revenue;
  • Loss of research time;
  • Loss of experiments;
  • Loss of use;
  • Business interruption; or
  • Loss of profit.

These exclusions apply regardless of the legal theory asserted.

Nothing in these terms limits any rights that may apply under mandatory consumer protection legislation.

Section 6

Warranty Claims Procedure

Step 1 — Notify DMT

All warranty claims must be submitted in writing within thirty (30) days after the defect becomes apparent and no later than the expiration of the applicable warranty period.

The following information should be included:

  • Product name and model number;
  • Serial number;
  • Date of shipment or purchase;
  • Description of the defect;
  • Photographs or supporting documentation where relevant.
Step 2 — Obtain an RMA Number

No product may be returned without a valid Return Material Authorization (“RMA”) number issued by DMT.

The RMA number must be clearly marked on the outer packaging of the returned shipment. Products returned without an RMA number may be refused.

Step 3 — Return the Product

Products must be returned in adequate protective packaging. Products damaged during return transit due to inadequate packaging will not qualify for warranty coverage.

Unless otherwise agreed in writing:

  • The purchaser is responsible for shipment of products to DMT;
  • DMT is responsible for standard return shipment of repaired or replacement products;
  • The purchaser remains responsible for all customs duties, VAT, import taxes, and similar charges.
Contact DMT before shipping any product. A return sent without a valid RMA number may be refused.
Section 7

Response Commitment

DMT will assess returned products and provide an initial evaluation within fifteen (15) business days following receipt.

Where a warranty claim is accepted, DMT will use commercially reasonable efforts to complete repair or replacement within thirty (30) business days, subject to parts availability.

If additional time is required, DMT will communicate an updated estimated completion date.

DMT shall not be liable for delays caused by circumstances beyond its reasonable control, including supply chain disruptions, transportation delays, labor shortages, governmental actions, or force majeure events.

Section 8

Replacement Products and Repaired Components

Products repaired or replaced under warranty shall remain covered only for the remainder of the original applicable warranty period.

Repair or replacement shall not restart or extend the original warranty period.

Section 9

Extended Warranty Program

Eligible products may be enrolled in DMT’s Extended Warranty Program pursuant to DMT’s Extended Warranty Terms and Conditions.

The Extended Warranty Program is available only for eligible products that remain within their original warranty period and meet the conditions specified by DMT.

Section 10

Governing Law and Disputes

These Warranty Terms shall be governed by and construed in accordance with the laws of Denmark, excluding its conflict-of-law rules.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Any dispute, controversy, or claim arising out of or in connection with these Warranty Terms shall be finally resolved by arbitration under the Rules of the Danish Institute of Arbitration.

The seat of arbitration shall be Copenhagen, Denmark. The language of the arbitration shall be English.

Warranty claim, technical support or planned maintenance?

Select the route that best matches the issue. A system fault is not automatically a warranty claim and may first require technical assessment.

Warranty or technical issue

Provide the product model, serial number, shipment or purchase date, defect description and relevant photographs or supporting documentation.

  • Do not dismantle the system unless instructed
  • Do not return the product without an RMA
  • Include software version where relevant
  • Describe any recent changes to the setup
Request technical support

Maintenance, inspection or recalibration

Normal wear, calibration drift and preventive maintenance are not necessarily warranty matters. DMT can advise on service, inspection and recalibration options.

  • Preventive system maintenance
